Well here they are. These are the entries that were picked. My plan is to sell these for cost on Cafe Press. My issue is that a couple of these pics, like Russo and Brads, look like they are professional photos, and we may not have permission to use them, even though SR wouldn't be making money off them. That being said, some people that may be in these pictures may not want to be. I am not sure of the legalities. MJ how does this work? :)

Well anyway here are the "potential" pictures.

I think as long as the pictures were purchased from the photographer than that person is the "owner" of the pic. & could use them as they see fit.

I'll have to dig through all the links that I have.

Between no profit and none of the locations being where the person has a right to believe they had a semi-right to privacy (someone changing into leathers between car doors or getting money from the ATM at a rest stop etc) there should be no issues.

As for purchaing the digital pic, it depends on the conditions they were sold under. In most cases the photographer holds the copyright and the purchaser only has "personal use" rights. So this being non-profit I think it may still be safe. But I'm no lawyer ;)

All of those photos are copyrighted by whoever took the photo. The use or copying of any work without permission from the owner of the copyright is a violation of the United States Copyright Act.
If you want to use somebody elses photos you need their permission (preferablly in writing) whether it is for profit or not. I'd get people to sign a licensing agreement allowing you permission to print calenders just to be safe.

It doesn't matter if it's a professional photo or not. Whoever took the photo owns the copyright.

Yeah I think he'll be fine too. I mean I really don't think anybody is going to sue Jeff but if somebody wanted to be a dick they could. Get a release signed it's really not too much work at all.

Its the paper trail, you actually have to get these releases to people, get them signed, get them all back. How the hell do you tell if a picture is a professional on or not? Some track day pics could, but I have taken track quailty pics that look like they could be.

Jeff. I can get you some filler pics that Robin took on CD by tonight if needed. They should be good enough for your uses. Just hav some from the Letchworth ride and the thing downtown.

I took that picture of Seth for October. I thought that picture rocked too! Gonna get more this summer! Maybe have Rodger review this and than just post your address up and if they want their picture in tyhe caldender they have to mail the signed form to you.

You have permission to use the ones I sent, all are my own, taken by me, from where I was standing at the time. All images are real and not imagined, photo shopped, or drawn with crayon.


I promise not to sue, but might blackmail you for the Motard :D

Well that takes care of pretty much all the photos, except the Russo Pic and the NYVtr Brad Wheelie pic. Maybe we can pull this off.. Email me the other pics jason. We might be able to pull this off. :)

Are you sure you have the high res pics too Jeff? I'm pretty sure that pic of Seth has a higher res version than the one you posted.

True.....but they were submitted knowing that they were for a calander and the front page which is why I didn't see too much of a deal as long as they were taken by the submitter. :D

Like a radio station, you call them and they do not have to tell you you are on the air, but if they call you they must inform you.

No not mine, belongs to Rob Beach, President of Beaches Motorcycle Adventures. It was my ride for several days while in Europe this summer.

It is an early '90's GS1100PD with about 190,000 kM on the clock. Ohlins rear shocks and some trick inverted forks, and dual disk front set up (good thing, because the back brake is worthless). The bike moves in the mountains pretty good once you get the hang of it.

Kinda.. I was going to get them made up with the pictures at cafe press but there is a rights issue with the pictures as they would be posted "for sale" . Id have to track down authors and get photo waivers signed. Too much a pain in the ass.

What if you don't tell them they are for sale, but call it "free with a donation" kind of thing... This way there is an exchange of money, but it's not totally illegal? It would be the truth anyway, right? I don't see anything wrong with that. ;)

Still a gray area. I think what we will do is add those shots to the front page rotation, and encourage people this year to TAKE YOUR OWN PICS so that way we don't have to worry about ownership rights for the 2009 calendar. ;)
